Both medical Marijuana and adult-use marijuana are legal in the State of Michigan. While the medical marijuana has been in MI since 2008, a commercialization bill passed in 2016. Recreational cannabis in Michigan was legalized in November of 2018, with recreational sales beginning a year after sooner than expected.

Even though the recreational marijuana market has taken some time to grow. Michigan, one of the first states in the midwest, along with Illinois, to legalize adult-use cannabis, has estimated cannabis sales of $730 million to $875 million only in 2020. And it’s projected to reach $2 billion by the year 2024.

Medical Marijuana In Michigan

Medical marijuana in Michigan allows patients in the state to purchase up to 2.5 ounces cannabis daily. The purchasing limit per month for patients is 10 ounces of cannabis. To qualify as a patient a certification from a physician is required.

If a patient or caregiver is found exceeding these amounts, they would face a civil fine of up to $250.

The Michigan medical marijuana program was legalized in 2016, by the passing of several measures, the main ones are:

  • HB 4209, which gave authority to license and regulate businesses
  • HB 4210, that amended the previous law allowing the production of cannabis infused products and edibles for medical purposes.
  • HB 4827, that established a commercial monitoring system. This particular bill replaced a 2008 ballot initiative that allowed for the possession and use of medical marijuana.

Does Michigan Accepts Patients from out of state

Yes. Medical marijuana patients from out of state can purchase cannabis in Michigan under the same regulations as locals.

Is Home Cultivation allowed in Michigan?

It is. Medical marijuana patients can cultivate up to 12 cannabis plants at home.  Whether it is, medically or recreationally, all cannabis plants must be grown inside locked, secured and in enclosed facilities that are not visible to the public.

An important detail, in the case of rented properties, the tenant must have the landlord’s authorization before growing cannabis.

Is transportation of MMJ allowed in Michigan?

Transporting medical marijuana in Michigan is legal for qualified patients and caregivers as long as the marijuana or marijuana-infused products being transported are:

  • In a sealed and labeled package
  • In the trunk of the car or in a location that is not accessible from the interior of the vehicle

Transporting medical marijuana from Michigan to other states is strictly prohibited and illegal under the Michigan Medical Marijuana Act. Medical cannabis is only for the patient and cannot be sold, transferred or exported to anyone in or out of the state of Michigan.

These restrictions include, but are not limited to, mailing, driving, shipping or flying cannabis across state lines.

What are the Business opportunities in Michigan For Medical Marijuana?

The state of Michigan is currently accepting new applications for medical marijuana businesses. Also, even though there are no plans to accepting other types new plant-touching licenses are being awarded now.

Recreational Marijuana in Michigan

Michigan passed Proposal 1 in 2018, that allowed adults of 21 and older to possess 2.5 ounces of cannabis when away from home. The possession of up to 10 ounces of cannabis in their homes is allowed , as well as 15 grams of concentrate at any given. No restrictions on the type of marijuana allowed to be sold.

Regulations for Recreational Marijuana Business in Michigan

The rules for recreational marijuana businesses in Michigan can be strict when it comes to testing, quality-control standards, daily purchase limits, transportation, tracking and marketing.

But the biggest setback for businesses in this state is that municipalities can enact bans or limit on the number of marijuana facilities, and cannabis businesses will not be able to operate in localities that have not regulated those types of facilities. Currently 1,411 cities and townships in Michigan have banned adult-use sales, making early availability extremely limited
