New Jersey Social Equity Definition

What is social equity in New Jersey

Social Equity is a legal term of art that means a person applying for a cannabis business license in New Jersey that has either been convicted of a marijuana related offense anywhere in the United States, or has resided in a disproportionately impacted area of New Jersey for 5 out of the last 10 years, with additional income limits.  Social Equity business applicants are granted priority 1 status under the Cannabis Regulatory Commission’s regulations. 

How do you prove that you are a social equity applicant?

New Jersey Social EquityIn New Jersey, the CRC has put out a form that all social equity applicants must complete before turning in their application. It requires proof and evidence of your qualification as a social equity applicant.

What evidence do Social Equity Applicants Need?

Very often the state granting the social equity certification sets their own requirements.  In New Jersey social equity, the state requires the following;

Social Equity for Long Time Resident of Economically Disadvantaged Area:

  1. Utility bill- water, sewer or energy that includes name of owner applicant, address, and year(s).
  2. Correspondence from the Internal Revenue Service or New Jersey Division of Taxation, which includes but is not limited to a 1099 Statement, Form 1098, W-2, etc. Documents shall include the name of the owner applicant, address, and year(s).
  3. Federal, State, or local government correspondence issued to the owner applicant which includes but is not limited to Social Security Administration documents, court issued notices, and property tax bills. Documents shall include the name of the owner applicant, address, and year(s).
  4. Signed lease agreement that includes name of the owner applicant, address, and year(s).
  5. Mortgage or property deed of property that is or was owner-occupied that includes name of the owner applicant, address, and year(s).
  6. Paycheck Stubs that include name of the owner applicant, address, and year(s).
  7. State or Federal issued identification card that includes name of the owner applicant, address, and year(s).

Social Equity Applicants for Marijuana related offense: 

  1. Local, State or Federal Court records, Probation documents, Department of Corrections or Federal Bureau of Prisons documents. All documents must contain the name and date of birth of the owner applicant, date of the marijuana related offense and the date of conviction or offense. Unless otherwise stipulated, documents need not be certified copies of a record or otherwise authenticated by a court unless; plain photocopies are acceptable.
  2. Superior Court of New Jersey Official Expungement Certificate that contains the name of the owner applicant, date of the marijuana related offense and the date of conviction or offense.
