What is Kentucky’s HB 136?

Kentucky cannabis lawyer, Nate Miller, believes HB 136 has a lot of good aspects in it (like home delivery) but he’s interested in seeing how the logistics of the bill will play out. HB 136 would allow cannabis access for qualified patients in Kentucky. Regulators are developing the full list of qualifying conditions but it will include chronic pain and multiple sclerosis. Including testing labs, there are five license types available under HB 136. This bill will not allow smokable, or “combustion”, of cannabis products. Read the full bill here.

What Cannabis Licenses are Available in Kentucky?

“There are growers, processors, dispensaries, and then there are what is called producers. Producers are essentially someone that does both the growing and the processing. There are a certain number of licenses in the bill that are allowed starting out, so statewide there are only going to be three producers starting out, five processors, 15 cultivators, and 25 dispensaries.” – Nate Miller, Suhre & Associates

The Kentucky cannabis lawyer team is the ideal choice for anyone needing assistance with a cannabis-related charge. Kentucky’s best cannabis law attorney will help you navigate the tangled, ever-changing legal waters of cannabis. They have the skill and experience to help you understand the Kentucky cannabis regulations that the state has put in place.

What Are the Kentucky Cannabis Regulations

Kentucky cannabis lawyers work with residents who usually know the Kentucky cannabis law and are familiar with the specific requirements. Here is a brief description of what Kentucky cannabis laws state, but it is important to know these Kentucky cannabis laws from the very beginning.

The legislation for the legalization of cannabis in Kentucky specifically states that only persons 21 years of age or older may legally consume cannabis. If someone under the age of 21 consumes cannabis, they can be charged with a crime. The penalties for a cannabis user under the age of 21 who is charged with a crime includes, but is not limited to, jail time, and a large fine. This is when a lawyer can help you.

The first thing an attorney does is to evaluate a client’s interests. The Kentucky cannabis lawyer will review the current law, such as the penalty for possession of cannabis, the jail time for possession of cannabis, and the potential health risks associated with cannabis consumption.

Based on the attorney’s findings, the cannabis lawyer will then draw up a strategy for either getting the ban lifted or fighting the enforcement of the ban in court. As they say, an ounce of prevention is worth a pound of cure.

The Cannabis Regulation and Safety Act are just one part of the cannabis laws of Kentucky. However, the cannabis laws in Kentucky are quite similar to many other states. Regulations are part of the local authority resolutions that comply with the overall national cannabis climate at the moment.

How Can a Kentucky Cannabis Lawyer Help You

When you find a qualified cannabis lawyer in Kentucky, you will have to hire him/her to represent you in a court of law if you were found guilty of any marijuana-related crime. Also, the lawyer must retain his/her qualifications and uphold the federal laws of Kentucky that outlaw cannabis.

As mentioned above, all the Kentucky cannabis laws are in place to protect the state from any loss of revenue due to the legalization of cannabis.

In the case that you were convicted of previous cannabis possession or distribution, you will have to go through the necessary steps to regain your liberty and continue to maintain your cannabis status in Kentucky. You will have to petition the court for either judicial or non-judicial relief.

To get your cannabis status restored or not, it is important to make sure that you are properly represented by an attorney and to make sure that you keep abreast of the Kentucky cannabis laws. This is because this is how your cannabis law attorney protects you from any future marijuana-related offenses.

Kentucky cannabis laws are particularly important if you are currently involved in the cannabis industry.

A legal team can also help negotiate with the prosecuting attorney. They can negotiate a reasonable disposition that will provide for a sentence that is just and in the best interest of all parties involved. They can also work towards a resolution that avoids jail time and in the best interests of all parties involved.
