Cannabis Licensing in California

As of 2021, the state’s three licensing authorities have issued more than 10,000 commercial cannabis licenses to cannabis businesses throughout California. There are more than 9,700 active licenses, including more than 6,000 cultivators, 800 manufacturers and 700 retailers, more than 300 delivery services, 1,000 distributors, 200 microbusinesses, 150 transporters, 38 event organizers and 36 testing laboratories.

What are the number of Business licenses allowed for the Cannabis industry in California?

California didn’t set a statewide capped number of licenses, contrary to many other states in the United States.

Although it does not have a statewide limit for the number of licenses approved for adult-use businesses, the state left it to the cities, which may govern their own numbers.

Taxes in California for Cannabis

On November 8, 2016, California voters approved Proposition 64, Control, Regulate and Tax Adult use of Marijuana Act, which establishes:

  • Effective since November 9, 2016, certain sales of medical marijuana are exempt from the sales and use tax.
  • Effective since January 1, 2018, a 15 percent excise tax is imposed upon purchasers of all marijuana and marijuana products. Additionally, a tax on cultivators of marijuana was imposed as follow:
    • $9.65 per dry-weight ounce of marijuana flowers
    • $2.87 per dry-weight ounce of marijuana leaves

Immature plants (including clones) and seeds are excluded from the cultivation tax.
